Confidentiality & Data Use
All information submitted is confidential and will not be sold or distributed to third parties except as required for underwriting, eligibility review, premium calculation, coverage determination, claims administration, policy servicing, regulatory compliance, or as otherwise required by law.
Nature of Product (Non-Insurance Disclosure)
This program is a private contractual risk support agreement specifically tailored for collegiate athletes. It is not a licensed insurance policy and does not constitute traditional insurance coverage.
Purpose of Information
Information provided by participants is used solely to evaluate eligibility, define covered and excluded matters, establish coverage limits, calculate premiums, and administer claims. Submission of information does not create coverage and does not guarantee approval, enrollment, or payout.
Scope of Financial Coverage
Coverage applies solely to verified NIL income, endorsement agreements, and other NIL-related compensation earned during an active policy term. Coverage is limited to up to one (1) year of NIL compensation. Coverage may extend to NIL agreements executed up to ninety (90) days prior to the date a claim is submitted, provided the policy was active at the time of the alleged disgrace event. Coverage may also include documented educational expenses lost as a direct result of a covered event.
Claims Submission Requirement
Claims must be submitted contemporaneously with the date of the alleged disgrace event or as soon as reasonably practicable thereafter. Failure to do so may result in a delayed or failed claims process.
Legal Costs & Settlement Exclusion
This program does not cover legal defense costs, attorney fees, court costs, arbitration costs, settlements, judgments, fines, penalties, restitution, or any payment arising from criminal, civil, regulatory, or administrative proceedings.
Covered Allegations
Subject to verification and strict compliance with all terms, covered matters may include: (1) Sexual assault or sexual misconduct allegations; (2) Non-sexual assault allegations; (3) Theft or grand larceny (non-financial crimes); (4) Administrative, institutional, or university disciplinary proceedings.
Excluded From Coverage
Expressly excluded: Murder or manslaughter; Fraud of any kind; Sexual crimes involving minors; Organized, repeated, or patterned criminal conduct; Prior undisclosed allegations; Any conduct occurring prior to policy activation not fully disclosed during underwriting.
Admission of Guilt
Coverage terminates immediately upon: a guilty plea; a confession or admission of wrongdoing; a criminal conviction; or acceptance of a civil judgment containing an admission of liability.
Policy Term
Policies are issued for a fixed twelve (12) month term beginning on the date enrollment is completed. Coverage applies only to events occurring during an active policy period.
NIL Reporting Requirement
Participants must report any material increase or decrease in NIL income or valuation within thirty (30) days. Unreported increases are not covered. Premium adjustments are not retroactive.
Dispute Resolution & Arbitration
Any dispute shall be resolved exclusively through binding individual arbitration. Participants waive the right to a jury trial and waive the right to participate in any class action, consolidated action, or representative proceeding.
Governing Law & Venue
This agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict-of-law principles.
Coverage Effective Date & Waiting Period
Coverage becomes effective on the date of enrollment and successful activation. A thirty (30) day entry period applies from the date of the triggering action or event. No claims may be submitted or honored during this 30-day period.
Entire Agreement
This document constitutes the entire agreement between the parties and supersedes all prior or contemporaneous communications, representations, or understandings.
